What is marriage tax allowance?

Marriage tax allowance lets couples transfer a percentage of their personal allowance between them, this allows the lower earner within the marriage or civil partnership to transfer part of their unused Personal Allowance to their higher-earning partner. Working with the HMRC we will look to get you a refund for the last 4 years, and we will arrange for you to get the benefit going forward, automatically, free of charge.

Your personal allowance is income that you can earn tax-free each year. A recent survey states that around 4 million married or civil partner couples are missing out on the tax break which could total over £1 billion.

Will it cost me anything to make a marriage tax allowance claim with Gowing Law Solicitors?

At Gowing Law, all Marriage Tax Allowance claims are processed on a No Win No Fee basis. For a No Win No Fee claim, you don’t need to worry about anything as we will bear all upfront costs, and you will only need to pay a fee if your claim is successful, this means you will never be out of pocket.

Am I eligible to make a claim?

As a marriage allowance is known in the UK as an elective tax break, it means that you won’t be able to find out or receive it unless you make the claim yourself. In other words, if you do not make the claim then the funds will simply remain with HMRC and the UK government.

The main factors that determine whether or not you are eligible for making marriage allowance claims are:

  • Being married or in a civil partnership (You cannot claim for a marriage allowance if you simply live together, rather than having signed a marriage licence.)
  • You or your partner earning more than your annual personal allowance. This should be between 12,500 and £50,000, if they are a basic tax rate payer.
  • You or your partner having a yearly income that ends up being less than your personal allowance. This should be under £12,500.

So, if you are applying for a marriage tax allowance claim, just remember that one of you needs to earn more than the other in order to move forward. That way you should be able to make a claim.
